Accommodation Contract – Haus Bergwelten

Upon booking, the version of these terms and conditions valid at the time of contract conclusion becomes part of the contract concluded with the accommodation provider (hereinafter referred to as “accommodation establishment”), unless deviating individual agreements have been made.
Please read the following conditions carefully.


1. Haus Bergwelten

1.1 These GTCs apply to contracts concluded with the accommodation establishment for the rental use of rooms for guest accommodation and for further services provided by the accommodation provider.

1.2 The customer’s terms and conditions only apply if this was agreed in advance.

1.3 With the booking—made verbally, in writing, by telephone, fax, online, or by email—the guest makes a binding offer to conclude a contract with the accommodation provider.

1.4 The contract is concluded upon the accommodation provider’s acceptance of the guest’s offer. A written confirmation may be issued, and a third party (e.g., the local tourist information office) may represent the provider.

1.5 If the content of the booking confirmation deviates from the offer, this constitutes a new offer, which the guest may accept within 10 days. This acceptance may be express or implied (e.g., through payment).

1.6 Contracting parties are the customer and the accommodation establishment. If a third party makes the booking, they are jointly liable with the customer if they provide a corresponding declaration.


2. Services, Arrival, Prices, Obligations

2.1 Provider’s Obligations
The accommodation provider must make the booked accommodation available and provide the agreed services. Unless confirmed otherwise in writing, there is no entitlement to specific rooms. Bookings are held until 6:00 p.m. unless notified of late arrival or prepayment is made.

2.2 Guest’s Obligations
The guest must accept and pay for the accommodation and any additional services. Rooms must be vacated by 12:00 p.m. on the day of departure. Late departures may be charged.

2.3 Prices and Adjustments
Prices include VAT and may be increased by up to 10% if general rates increase and more than four months lie between contract conclusion and fulfillment. Changes in guest numbers, stay duration, or services may also affect pricing.

2.4 Other Guest Obligations
The accommodation is to be used as intended and only by those listed in the booking. Subletting requires written consent. The guest must report defects immediately and allow the provider to remedy them. Guests may terminate the contract in serious cases. Pets require prior agreement. The guest is liable for their animals.


3. Payment, Offsetting, Security

3.1 Payment Terms
Unless otherwise agreed, payment is due on departure. A deposit of 10–30% may be required. Interim invoices may be issued during the stay. Late payment incurs interest (5% for consumers, 8% for businesses above the base rate), and reminder fees apply.

3.2 Credit Cards, Checks, Other Payment Methods
Acceptance of payment methods is at the provider’s discretion. Credit card acceptance is not guaranteed even if indicated.

3.3 Offsetting
Offsetting is only permitted with uncontested or legally established claims.

3.4 Security
If payment is not made, the provider has a lien on the guest’s belongings and may retain or sell them to cover debts.


4. Service Changes or Deviations

Minor and reasonable deviations (e.g., replacement accommodations) are allowed with valid justification. Guests must be informed promptly and may be offered free rebooking or cancellation. In case of last-minute cancellations, the provider must arrange equivalent alternative accommodation within 4 hours, at their own cost.


5. Withdrawal and No-show

5.1 Guest Withdrawal
Withdrawal is possible at any time before the stay, ideally in writing. The guest remains liable unless a replacement is found. Standard charges:

  • Vacation homes/no meals: 90%

  • With breakfast: 80%

  • Half-board: 70%

  • Full-board: 60%

Guests may prove lesser loss or that the room was re-rented. Travel cancellation insurance is recommended.

5.2 Provider Withdrawal
Withdrawal is possible if the guest doesn’t confirm the booking upon request, doesn’t pay the deposit, or in serious cases (e.g., misleading booking info, security concerns). Guests will be informed within 14 days. No damage claims arise from justified withdrawal.


6. Early Termination

Fixed-term contracts end automatically. Early departure does not affect the full payment obligation. The provider will attempt to rebook but is not obligated to make special efforts. The contract ends upon the guest’s death.


7. Liability

7.1 Contractual Liability
Liability is limited to intent/gross negligence and violations of typical duties or life/health. Guests must help minimize damage and report issues promptly.

7.2 Liability for Belongings
Liability is up to 100 times the room price (max €3,500), or €800 for valuables unless stored in a safe (€10,000 max). Losses must be reported immediately.

7.3 Parking
Parking does not constitute safekeeping. Liability only exists in cases of intent/gross negligence.

7.4 Wake-up Calls, Mail
Wake-up calls and mail are handled with care. The provider may forward items on request.


8. Limitation Period

8.1 Claims (excluding tort) expire after one year.
8.2 The period begins at year-end upon knowledge of the claim.
8.3 Ongoing negotiations suspend the period until declared ended.


9. Data Protection

9.1–9.4 Personal data is collected and processed solely for booking and services and may be shared with third parties for these purposes. Guests have the right to access, correct, block, or delete data. Consent to marketing use may be revoked at any time.


10. Final Provisions, Jurisdiction, Law

10.1 Amendments must be in writing.
10.2 German law applies exclusively.
10.3 Legal action must be brought at the provider’s location.
10.4 For guests abroad, the provider’s location is also jurisdiction.
10.5 Invalid provisions do not affect the rest of the terms.
